I am proud to announce that my voting record has earned me a spot on the NSSF "Dean's List". Shooting and hunting are a way of life in Minnesota, and I am proud to have voted for those priorities 100% of the time while here in Congress. NSSF is the leading advocate for recreational shooting and hunting and I am thankful for their recognition and these kind words:

 

“The 2024 NSSF Congressional Report Card is a comprehensive analysis of our elected representatives’ positions on firearm and ammunition industry priorities in the 118th Congress. The Report Card’s grades are based on key votes, co-sponsorships, committee activity, floor speeches, and other official actions by Senators and Members of the U.S. House of Representatives. Members of our industry are grateful to have so many strong allies in the Halls of Congress,” said Lawrence G. Keane, NSSF Senior Vice President for Government & Public Affairs and General Counsel.

Fischbach has gone above and beyond to protect and preserve the Second Amendment rights of her constituents and the industry that makes the exercise of those rights possible. We applaud Rep. Below are some examples of my most recent work to defend your Second Amendment rights.

 

 

Don't Make Minnesota California

California recently passed legislation implementing a new 11% excise tax on firearms ammunition. This is clearly an attempt to try to price Americans out of their Second Amendment rights. Since states like Minnesota seem inexplicably interested in following California's bad example, I cosponsored the Freedom from Unfair Gun Taxes Act to prohibit states from implementing an an additional excise tax on firearms. This would preempt the California law and keep other states from following their lead.

 

RIFLE Act

Under the Biden-Harris Administration, the ATF has been abusing its power, using even the most minor of clerical errors by firearms dealers, like using a state's abbreviation rather than full name, to claim they are "willfully violating" ATF regulations. This is a departure from their long history of partnering with Federal Firearm Licensees. I cosponsored the Reining in Federal Licensing Enforcement Act of 2024 or RIFLE Act to create a clear definition of what constitutes "willful violation," imposing a presumption that there is no willful violation without clear and convincing evidence. It also allows those whose licenses were revoked to appeal their case and to reapply for their license under this new definition.

 

Protecting the Mailing of Firearms

While you can currently ship any firearm or ammunition through a common carrier and mail shotguns and rifles through the U.S. Postal Service, yet federal statutes arbitrarily prohibit mailing concealable firearms like handguns, suppressors, and short-barreled rifles through USPS. This is another example of unnecessary federal regulations and I have heard from gun-owners in the Seventh District that they would like to see this changed. I cosponsored the Protecting the Mailing of Firearms Act to repeal the prohibition on USPS shipping these currently prohibited firearms, and prohibits the Postmaster General from making any rules that block the shipping of firearms or ammunition in the future.

 

 

Keeping the Federal Government Out of Your Personal Life

The ATF recently proposed a rule that would insert the federal government into private transactions of firearms between individuals by broadening the definition of "Engaged in the Business" as a dealer in firearms. It would require anyone who sells a firearm with the intent to "predominantly earn a profit" to get a Federal Firearms License. Violators would be put at risk of coming under federal investigation. This is an attempt by the Biden Administration to implement universal background checks. This is why I have cosponsored a resolution to trigger the Congressional Review Act which would overturn this ATF rule, and protect private sales and transactions.

 

Hunting and Fishing Day

Finally, last weekend we celebrated Hunting and Fishing Day. This is our way of life in Minnesota and I am happy to celebrate the generations of sportsmen and women and their conservation efforts that guarantee future generations will be able to enjoy these pastimes for years to come.
